Privacy Notice

Definitions

User/You – a natural person visiting the website.

GDPR – Regulation (EU) 2016/679 of the European Parliament of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Notice – this Privacy Notice which sets out how users’ personal information obtained by the Foundation is collected, processed and used.

Personal Data – any information about a natural person identified or identifiable by one or several specific factors defining the physical, physiological, genetic, psychological, economical, cultural or social identify of that natural person, including IP address, location data, online identifier and information collected by cookies or a similar technology.

§1 Personal Data Protection

  1. Personal data of users of the website contained in the registration form and personal data collected automatically are processed in accordance with article 13 of the GDPR and the Digital Services Act dated 18 July 2002 (JoL 2002, no. 144, item 1204, as amended). Users have the right to request access to and correction of their personal data. Data collected automatically cannot be changed or erased.

  2. The Foundation acts as the controller of personal data processed in the way described by this notice. In matters regarding the protection of personal data and privacy in the broad sense you may contact us by email at info@artmodernfoundation.pl, or send your query to the Foundation by post.

  3. Purposes and legal bases for the processing of personal data:

    a. Potential determination and pursuit of claims or defence against claims for the purposes of the legitimate interests pursued by the controller (Art. 6, subpara 1, point f GDPR) that involves protection of the controller’s rights.

    b. Analytical and statistical purposes related to the legitimate interests pursued by the controller (Art. 6, subpara 1, point f GDPR) that involve analysing user behaviour and activity as well as their preferences in order to improve the quality and adequacy of functionalities and provided services.

  4. Users’ personal data are confidential and protected against unauthorised access and are not shared with third parties. The Foundation uses the SSL security protocol for encrypting communication.

  5. The Foundation reserves the right to use internet tools such as Google Analytics to keep website traffic statistics.

  6. Each user has the right to request access, correction, erasure or restriction of the processing of their personal data, to object and to lodge a complaint with regulators.

  7. You have the following rights as regards the processing of your personal data:

    • the right to access your personal data (Art. 15 GDPR),

    • the right to have inaccurate or incomplete personal data updated or amended (Art. 16 GDPR),

    • the right to have your personal data erased (Art. 17 GDPR),

    • the right to request restriction of the processing of your personal data (Art. ? GDPR),

    • the right to object to your personal data being processed (Art. 21 GDPR),

    • the right to request transfer of your personal data (Art. 20 GDPR),

    • the right not to be subject to a decision based solely on automated processing, including profiling (Art. 22 GDPR).

    • You also have the right to withdraw your consent to your personal data being processed at any time, which will not affect the lawfulness of any processing carried out by the Foundation before you withdraw your consent.

  8. Personal data will be processed for the duration of the consent to the processing of personal data and for the duration of pursuit of relevant claims.

§2 Cookies

  1. This site uses cookies which are small text files stored on a user’s computer, and other similar technologies. We do not use these mechanisms to collect information about individual users of the website, they are used to keep statistics on website traffic and to improve the functioning of the website to meet online standards.

  2. We process cookies for 2 reasons:

    • Website architecture needs cookies to provide services in an appropriate and correct way. They are necessary for this website to function. These are so-called technical cookies. If you delete or refuse consent to them, this may affect the functioning of the site.

    • We wish to cater for the needs of our users and we analyse anonymised data on website use for this purpose.

3. In many cases software systems designed to access websites (web browsers) implicitly allow the storage of cookies on a user’s terminal equipment. Users of this website can change their cookie settings at any time. The settings may especially be changed to block automated cookie management in web browser settings or to have the information about their placement on a user’s device each time displayed. 4. The Foundation lets it be known that restriction to the usage of cookies may affect some of the functionalities on the website’s pages.

§3 Final provisions

  1. This website run by the Foundation may contain links and references to other websites. The Foundation is not liable for how they protect privacy.

  3. This Privacy Notice comes into effect on 6 December 2024.
